Immigration Law Alert – 12/3/21

Amended CDC Covid Test Requirements for All US Bound Travelers

On December 2, 2021, the US CDC announced that it will implement more stringent Covid testing requirements for all US travelers, regardless of vaccination or citizenship status. Effective December 6, 2021, ANY traveler 2 years or older must present the following to board a US bound flight from a foreign country:

  1. Paper or digital documentation of negative COVID-19 test taken within 1 calendar day before the flight’s departure from a foreign country; or

  2. Documentation of Recovery from COVID-19 in the past 90 days, consisting of both: i) a COVID-19 positive test result taken within 90 days before the flight; and ii) a letter from a licensed healthcare provider or public health official stating that the person has been cleared for travel (i.e., they have recovered).

This Order exempts individuals subject to certain humanitarian exemptions from the above requirements. To view the CDC Amended Order, please see https://www.cdc.gov/quarantine/fr-proof-negative-test.html

Given the frequent changes in travel policies, Tocci & Lee continues to advise foreign national clients to cautiously consider travel as they may encounter delays in their return to the US. We are continuing to monitor the implementation of this new policy and will provide updates as they become available.
